I too had similar reservations about the new provision, omitting the phrase, "otherwise then in police custody", changes the whole scenario & make the Magistrate's power, somewhat unchecked. Glad, that a Senior Advocate such as yourself is raising it.

Fully Agreed. Let the opposition fight among themselves for Cabinet berths. And when the coalition falls apart, which it eventually will, probably within a year or two, don't stake claim to form government. Call the fresh elections again.
In the past, e.g., 1989-90, 1998-2004, BJP was in coalition but came to grief and were disasters for BJP. Now again Modi wants to be PM in a coalition, which is after 10 years (2014-2024) of Hindutva. BJP hence should sit in opposition and reduce the I.N.D.I.A government to dust.
