This is a must read for anyone working on general jurisprudence. It's careful and nuanced, both in its attention to methodology and in its development of a trimmed-down form of nonpositivism. Even people with strongly positivist intuitions, like me, will find a lot to agree with.

Im STAAT erscheint unsere empirische Studie zum Grundsatz der Verhältnismäßigkeit am BVerfG. Sie kommt zu dem Ergebnis, dass die Vhmk in der Praxis bei weitem nicht so dominant ist, wie oft behauptet. Gleiches gilt für die Angemessenheit. doi.org/nkjt @DunckerHumblot
