Dear @KenPaxtonTX, Dallas county school districts have been informed that the DHHS order precludes them from providing ANY in-person education services to children with learning disabilities who cannot learn remotely. How is this order legal, as-applied?
I’m waiting to see how @JudgeClayJ has ensured that the DCHHS order does not run afoul of FAPE requirements guaranteed under IDEA to kids with disabilities who cannot learn remotely - especially where remote learning was already determined to be ineffective for the child.
