Always fun to talk with @dahlialithwick.bsky.social even if the subject isn't fun (SCOTUS and environmental law). Confusing case, messy argument, big implications for (arguably) the most important environmental law of all: NEPA. tinyurl.com/wn82yztb
Pretty infuriating that WSJ op-ed pages the day before argument seem to function as supplemental briefs. I trust that the Justices read the parties' briefs with the same attention. (This from yesterday's SCOTUS NEPA argument.)

Texas AG Ken Paxton w other states and gun rights orgs sued the ATF and Justice Department to stop a new rule that closed a loophole that let people sell guns online, at gun shows, etc. without conducting background checks on buyers.

Heartbroken that I won't see Dune 2 on opening weekend. Kvelling that it's because my teen daughter wants me to wait so we can go together. She'd be mortified that I've outed her, except that she's never heard of Twitter. Or X. nytimes.com/2024/02/29/mov…
I would say it's extraordinary for SCOTUS to hold an emergency hearing about a new Clean Air Act regulation before a lower court can even review its legality. But it's kind of becoming business as normal. Here's my take: salon.com/2024/02/15/the…
This pattern repeats itself everywhere in government. Privatizing government is not a good idea. Allowing private companies to take over government processes on the sly is even worse.

I just figured out how to have Microsoft Word continue checking grammar while keeping its opinions about commas to itself. It's already a good day.
There are hundreds of applicants every year who would make great SCOTUS clerks; actually landing one has as much to do with privilege and luck as merit. So what makes them worth $500k? Biglaw uses them as symbols of access, influence, and prestige. washingtonpost.com/politics/2024/…
