Alex: It's just as important -- if not more -- to go off-script with questions during custodian interviews vs. sticking to your pre-defined list. Custodians will reveal unexpected information, and you need to be prepared and comfortable with following that path. #RelativityFest
Alex: It's your obligation as an #attorney to understand how your client is using technology. If your client is using a tool you aren't familiar with, get familiar or bring in an expert. You can't just skip things you don't understand during custodian interviews. #RelativityFest
Erica: Pay attention to a custodian's physical and other cues during an interview. Remember: this person may eventually be a witness during a trial, so it's extremely valuable to have this insight early on, as it may better inform your case strategy. #RelativityFest #ediscovery
Tim: #Attorneys, during custodian interviews, make the Upjohn warning clear: "I represent the company, not you." But it's an art, not a science, to know when and how to share this without making the custodian uneasy. Tread carefully. #RelativityFest #ediscovery
Erica Noel, McDermott: Understand that custodian and IT interviews for #ediscovery are not "one and done." You need to be open to circling back to confirm or clarify as needed, because new details emerge and you want to be well-informed. #RelativityFest
Alex Godofsky, McDermott: When interviewing custodians, don't ask "Do you use other communication tools for work?" Ask about specific apps: "Do you use Slack? Skype? WhatsApp? Texting?" You'll get better, more accurate answers and set aside forgetfulness issues. #RelativityFest
Tim Gleason, McDermott: Interviewing custodians via phone may make for easier scheduling, but you could miss important body language cues and custodians are less likely to take it seriously. If geography is a problem, consider a video conference as a compromise. #RelativityFest
