4/n Justice Oka begins: When we talk about responsible and reliable judiciary, we tend to ignore the trial judiciary. I will focus on them. We must remember one thing. The responsibility and obligation to ensure fundamental rights is not only on HC and SC but on all courts.
5/n Therefore it is the duty of every court to uphold the constitution and its ethos. Let us understand the scene in the trial courts today. National Judicial Data Grid has data regarding pendency in detail. The sanctioned strength is 29 thousand. 21 thousand posts are filled
6/n Each court in our trial judiciary has to deal with thousands of cases. In High Court, the pendency is 61 lakh cases, out of which 70% are civil and others are criminal. Broadly, each judge has to deal with minimum 8-9l cases.
7/nTherefore, when we talk about a responsible and reliable judiciary, we must remember the huge burden on the judiciary. The trial court is the backbone, imparting justice to common man. Each judge must be able to render justice without fear and favour,
8/n The judge must abide by the values under our constitution. These values are in the preamble. Secularism, Justice, Freedom, Liberty Equality, Even outside the court, the conduct of the judge must show that he is bound by the ideals of the constitution.
9/n In a recent function I attended, Prof. Upendra Baxi had an interaction with a retd. Judge. The question was how could you describe the best three qualities of a judge. Prof Baxi said – spine, spine, spine!
10/n Duty to uphold Constitution on all judges! Let us look at a remand judge. He has to check whether the police and state machinery have complied with the constitutional mandate, and whether the accused has been informed of ground of arrest, right to representation etc.,
11/n and to enquire whether he has been ill treated in custody. This is the most important stage where the judicial magistrate can uphold the constitution. State judicial academies have all started imparting extensive training on this.
