AILAJ’s National Demand Day saw protests in Bihar, W.Bengal, Andhra Pradesh, Karbi, UP, Kerala while pamphlets were distributed in other States including K'taka + Delhi. We demand an Advocate Protection Act to ensure physical and socio-economic security for every Advocate!

6/n Each court in our trial judiciary has to deal with thousands of cases. In High Court, the pendency is 61 lakh cases, out of which 70% are civil and others are criminal. Broadly, each judge has to deal with minimum 8-9l cases.

8/n The judge must abide by the values under our constitution. These values are in the preamble. Secularism, Justice, Freedom, Liberty Equality, Even outside the court, the conduct of the judge must show that he is bound by the ideals of the constitution.

9/n In a recent function I attended, Prof. Upendra Baxi had an interaction with a retd. Judge. The question was how could you describe the best three qualities of a judge. Prof Baxi said – spine, spine, spine!

10/n Duty to uphold Constitution on all judges! Let us look at a remand judge. He has to check whether the police and state machinery have complied with the constitutional mandate, and whether the accused has been informed of ground of arrest, right to representation etc.,

11/n and to enquire whether he has been ill treated in custody. This is the most important stage where the judicial magistrate can uphold the constitution. State judicial academies have all started imparting extensive training on this.

12/n Responsibility and reliability go hand in hand. When a magistrate behaves responsibly, the system becomes more reliable. There are three issues we can look at : Delays in the system, adjournments and quality of justice rendered.
