One law at a time, are we making launching or sustaining a small independent business a more daunting path to growth and prosperity?

Political narratives focus on Uber and Lyft. But limiting self-employment has a long reach - far beyond just the rideshare apps. Self-employment has always held opportunities for creatives and those with a growth mindset.

Who works as an independent contractor? Think:   ✂️Barbers/hairstylists 🚚Truck drivers ✒️Writers/editors 📸Photographers 💼Entrepreneurs 🎨Artists/designers 🤝Consultants 👟Fitness trainers 💍Wedding planners   It's a heck of a lot more than just rideshare drivers.

Independent contractors are essential to small business success in today's modern (heavily regulated) economy. But not everyone sees the benefits. Some see only threats. The NLRB is at the nerve center of efforts by multiple agencies to define the line btwn employee and IC.

1/7 There is a concerted media effort happening to build up the @NLRBGC reputation. This is a big P.R. push for one of the Biden appointees trying to change the definition of independent contractors. washingtonpost.com/business/2022/…

We put our small businesses in jeopardy when we reward political influencers for building narratives that bad actors prevail. They make marginal cases central. They claim that all businesses cannot be trusted to treat people fairly without heavy, burdensome gov regulations.

Great points. No one really knows how much some of these regulations will cost businesses. But gov paid leave strikes at the heart of a business's capacity to be reliable to their customers, clients, and patients. Not all can accommodate this broad, generous benefit.

Opinion: Colorado lawmakers are increasing the cost of running a business cosun.co/3uuF7Ru

A recent study by Edelman Intelligence commissioned by @Upwork is further evidence that the independent contractor model must be allowed to evolve - technology has opened the horizon to new frontiers for work/life balance and human productivity. upwork.com/documents/free…

Challenges to independent contractors are finding their way into statutes throughout our laws. Proponents of SB176 want to protect independent contractors from harassment. That is the "why." But the "how" is the problem. bit.ly/3v8CX8Z

CO is sending signals that its business climate is litigious. A growing backlog of newly minted laws will have a heavier negative impact on small firms. As implementation brings clarity, will we see more growth shift toward large, mature firms? bit.ly/3v8CX8Z

Overheated efforts by lawmakers to catch worker misclassification have tripped up the growing number of individuals exploring new ways to work and be their own boss. Data makes it clear. For most of them, this is a beneficial choice made consciously. fightforfreelancersusa.com/the-people/

CO SB176 passed out of Appropriations on a party-line vote, 4-3. Deliberations on the Senate floor are expected to include the proposal of amendments. The language that will replace "severe or pervasive" is of critical importance. Will it be clear? Or vague and complex?

Will CO Sen Appropriations members approve SB176 this morning? An expansion of the CO Anti-Discrimination Act will lead to more litigation and compliance. Yet it is unlikely to lead to improvements to workplace relations that rely on more connection, not less.🧵 1/3

Are worker protections going too far? SB176 extends employer liabilities to independent contractors. This will have an outsized impact on the small businesses who engage as IC's and/or depend on them. bit.ly/3wBinzL

More fluid access to #workbased #learning is essential to mitigate failing education. Without it, those who leave K-12 with poor skills or no springboard into modern commerce have few options. Small businesses can be champions of WBL if given that freedom. #smallbusinesses

Employers faced with uncertain future revenues but certain mounting costs of labor as payroll taxes will be cautious with hiring. Many of these costs loom for 22/23/24. But small businesses will want to avoid the painful process of probable future staffing or pay cuts.

There were 150,000 fewer jobs in CO in Dec 2020 compared to Jan of the same year, representing a 5.4% cut. Learn more about CO’s competitiveness in the latest CSI analysis. bit.ly/2MY4vhd #coleg #copolitics #COVID19inColorado

Policies like #paidleave impose universal compensation terms on all employers that may crowd out or threaten what workers value about working in small business environments. There's a much wider range of job satisfaction variables than many policymakers are willing to recognize.

CO’s new paid leave mandate, “...erodes business diversity. It forces a poorly suited policy on small independent firms. They are already squeezed by growing competition and burdensome regulations…” #copolitics #coleg coloradopolitics.com/opinion/the-po…

Small firms occupy an increasingly unstable space as policymakers impose ill-suited laws and burdens on them that erode their viability. At the same time, market and tech changes leave them struggling to reinvent to hold onto market share. @copo_opinion #paidleave

#FamilyBusinesses really treat their employees like family. As this article puts it, people who have worked for you a long time are like an extension of your immediate family. #CALeg keep that in mind as you pass bills that affect us. ow.ly/TwfZ50DUtGG

A significant hike in the taxes required to restore the state unemployment fund will be a heavy blow to small businesses already struggling with defeat as a result of this last year.

To rebuild the fund and repay federal loans, business taxes are projected to increase by more than $500M annually within next 3 years. Read the latest from CSI and learn more. bit.ly/2MY4vhd #coleg #copolitics #COVID19inColorado

The cost of doing business in Colorado continues to rise. Too much of that is due to an unbalanced CO Leg that consistently dismisses the impact of policies on our business climate.

CO’s economy ranked #1 in 2019. Today, CO has 150,000 fewer jobs, state unemployment ranks nearly last, sales tax revenue dropped $8.9B, small business revenue is down 29.5% from Jan 2020 levels. Read more about CO’s competitiveness: bit.ly/2MY4vhd #coleg #copolitics

This is not a new problem. It has plagued the government paid leave approach since the beginning. The policy is too big, complex, and confusing. Displacing and entrusting it to public administration is a recipe for failure. bwnews.pr/3shKCAy
