I would argue that moment began in 2016. But back then, we were dismissed as hysterical. Back then, we were told the “institutions” will save us. And now you see what we meant back then—and that it’s too late now.

So true. Just absurd the way that SCOTUS has used a narrow law from 1925 to allow corporations unfettered rights to their own privatized tribunals whenever a victim seeks to hold them to account for breaking democratically passed laws to protect workers, consumers, and the public

Spot on analysis

All right, I really should be doing literally anything else with my time, but I have certain compulsions, so here's a short thread on the Harvard thing. Or actually, not about Harvard per se, because I, like most Americans, don't really give a shit what goes on at Harvard.

This argument is speculative at best.

Lawyers bragging to their lawyer friends like “I absolutely roasted opposing counsel in my brief” when in reality in one sentence in their response brief they alleged opposing counsel’s argument was “without merit”

I have made it to the promised land. Find me at ksimplicio.bsky.social

State bar associations need to start sanctioning lawyers who participate in making legally frivolous and factually baseless threats like this.

1. Last week, 7 GOP state attorneys general sent a letter to Target warning that selling LGBTQ-themed merch "to families and young children" may be illegal The letter alleges selling "LGBT-themed onesies, bibs, and overalls, t-shirts" could violate "child-protection laws" 🧵

Put Whitehouse in charge of the judicary committee, prioritize DC statehood, and make court ethics and reform an election issue. We dodged a bullet on the independent state legislature theory but we are on borrowed time now.

Sure would have been nice if SCOTUS had let those 8,000 consumers that Transunion labeled as terrorists clarify their rights under FCRA a few years ago.

BREAKING: The Supreme Court ends race-based affirmative action in higher education

The Supreme Court ended affirmative action today. Expected but disappointing. Now do legacy admissions. They absolutely disadvantage people of color, women and families who have been low-income for generations. They must end.

I long to live in a sane country, where DC had actual voting rights, and members of Congress spent their time dealing with actual problems, instead of nitpicking the traffic rules of a city in which none of their constituents actually live.

In a draft federal spending bill, House Republicans are proposing a whole slate of new and old restrictions on D.C. The ban on legalizing marijuana sales would remain, the city's assisted suicide law would be repealed, traffic cameras would be banned, right turns on red allowed.

Appalling that they did this, appalling this behavior was allowed to go on for over a decade, appalling that these are the lawyers advising companies on labor and employment issues.

Law firm partners are often Exhibit A of “Do as I say, not as I do.” But here… don’t do as John Barber or Jeff Ranen say, either. Disgusting and shocking but glad they put this in Lewis Brisbois firm emails so these see the light of day. nypost.com/2023/06/03/wok… #lawtwitter

Great read here. It is unfortunate that we even need legislation prohibiting corporate lawyers from inserting illegal clauses into employee contracts. It should be a matter of basic ethics. Glad to see Molly and @PeoplesParity leading the way on this!

“The lawsuit is the first of its kind in utilizing the new legislation to take a multilevel marketing company to court in a class-action lawsuit.”

Beachbody’s secret sauce? A vast network of more than 300,000 coaches. In a class-action suit, some of the company’s coaches allege they’re key to the company’s growth but haven’t been paid accordingly. latimes.com/business/story…

Proud to be filing this important case against Beachbody with my colleagues at @TyckoZavareei and @ClarksonLawFirm For too long, MLMs have gotten away with misclassifying the people that build their empires. Its time to give Beachbody coaches the pay and respect they are owed.
